I was dismayed to be told that many Labour MP's will probably do as they are told by their leaders and will refuse to sign, as it was Labour "under Tony Blair" that signed and introduced this one sided treaty.
I believe that this horrendous extradition treaty should be above party politics and that any honest MP of whatever persuasion would wish to sign this EDM, the wording of which is further down this page.

An email was sent by a supporter to David Drew Labour MP urging his support.

David Drew responded almost instantly saying that he won't sign at the moment because it fails to mention that Gary has been tried in this country regarding the extradition.

He is happy for him to serve any sentence in this country (assuming he is found guilty!) but feels the other aspects of the EDM undermine British justice.

Below is the wording of the EDM which absolutely does not undermine British Justice in any way, in fact quite the reverse.

Gary has never been tried in any court in the U.K as under the 2003 extradition treaty, no one is allowed to defend themselves against any allegations. They can only object to the extradition on Human Rights Grounds as no evidence is required in order to extradite any U.K citizen.

How could Labour MP David Drew say that "other aspects of the EDM" undermine British Justice, when the reverse is true.

That this House notes the accepted practice of the governments of Israel and the Netherlands of requiring assurances from the US Administration prior to their nationals being deported to face trial in the United States in cases involving defendants suffering from medical or mental health disabilities, that those nationals will be repatriated to serve any sentence imposed by the relevant United States court; and urges the Home Secretary not to permit the extradition to the United States of Mr Gary McKinnon of Palmers Green, London, an Asperger's syndrome sufferer charged with computer misuse in the United States, until such time as she receives express assurances from the US Administration that in the event of his being found guilty and sentenced to a term of imprisonment that administration agrees to the immediate repatriation of Mr McKinnon post trial to serve any such sentence in the United Kingdom.

Time for all honest MP's, Labour or otherwise, to outlaw this one sided extradition treaty that has abolished the hard won rights of U.K citizens and has given greater rights to U.S citizens.
The U.K has to provide proof/actual evidence, in order to extradite any U.S citizen, whereas the U.S can make merely an allegation against any U.K citizen to enable the U.S to extradite them.
It is therefore no surprise that the U.K government has extradited virtually no U.S citizen in the past few years, wheras the U.S has and is in the process of extraditing approx. 100 U.K citizens.

It is time for our government to realise that they work for us and not for the U.S.A.
The first obligation of any government is to protect the rights of its own citizens.

Let's name all of the MP's who refuse to sign this EDM and who refuse to stand up against this one sided treaty, that has betrayed and given away the rights of British citizens and for no other reason than to appease the American Government.
We are not second class citizens and we should refuse to be treated as such.

I got a good response from my MP. He stated that the Conservative Party has attempted in the past to alter the imbalanced extradition law, but have been voted down by the government.

However the main point of my letter was to elevate Gary's footprint in the minds of Whitehall.

This case has bothered me from the start. Thank you for the opportunity to provide some input. I hope other readers of this blog will do the same.

I wrote to my MP - the very first time I've ever done so - and would urge everyone to do the same.
It was easy: Just visit www.writetothem.com, enter your post code, and your MP's details appear. A quick note later ("please sign EDM2388, etc.") and you're done. Easy.

Let's do what we can to ensure Gary doesn't serve any potential prison sentence in the US.
Beyond that we should get this scandalously one-sided extradition treaty scrapped, so that no one has to go through this again.

When the US government purposefully withholds information vital to a coroner's review into the death of UK personnel in Iraq, why should we lift a finger to help them prosecute a computer hacker?

This is another example of our government failing to do its first duty to the people - to protect them.

i spoke to David Drew on the phone last friday. He said that in general he believed that 'criminals' who face extradition should be sent from this country, and that if they were innocent they had nothing to fear. I explained that Gary had not been charged with any offence here, that his case had been dragged on over six and a half years, and that he was suffering from a recognised health condition (Asperger's Syndrome) David Drew continued what seemed like a 'set piece' argument, seemingly unable to distinguish Gary from violent terrorists and unwilling to concede that his health problems and current severe depression should be any bar to removing him from his home country.
i said that our Government does not protect the rights and welfare of our citizens. David Drew responded by saying ( almost shouting, actually) "That makes me furious!" He continued to rant on for a few seconds, by which time i was so angry myself that unfortunately i told him to 'p... off' and ended the call.
if only i had been able to continue the argument and persuade him to rethink his position, but i really don't think it would have happened.
My daughter contacted Drew's office yeaterday, and told a very nice lady assistant of her dismay at his stance, and her concern for Gary's mental health and welfare while potentially facing the rest of his life in an American prison. This lady said she would personally lean on David Drew and make sure he did sign the EDM, brave lady - she must identify with the rest of us. I hope we can find out which MPs actually do sign the motion.
Trying to change the 'hive mind' of this Government puts us up against a solid barrier of self interest and defensiveness. If they only once admit a chink of doubt, the cracks would be unstoppable. The International Covenant on Civil and Political Rights is a United Nations treaty based on the Universal Declaration of Human Rights, created in 1966 and entered into force on 23 March 1976. Nations that have signed this treaty are bound by it.

Convention provisions

Five categories

1. Protection on individual's physical integrity (against things such as execution, torture, and arbitrary arrest).
2. Procedural fairness in law (rule of law, rights upon arrest, trial, basic conditions must be met when imprisoned, rights to a lawyer, impartial process in trial).
3. Protection based on gender, religious, racial or other forms of discrimination.
4. Individual freedom of belief, speech, association, freedom of press, right to hold assembly.
5. Right to political participation (organise a political party, vote, voice contempt for current political authority).

Two optional protocols

1. Mechanism by which individuals can launch complaints against member states.
2. Abolition of the death penalty.

The Universal Declaration of Human Rights (UDHR) was adopted as binding international treaty into two distinct and different covenants, the International Covenant on Civil and Political Rights(ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR). The two Covenants form treaty law, that is international human rights law, and ratifying parties (nation states) to the Covenant commit themselves to implement the contained rights in their domestic jurisdictions. Note that some states have signed but not ratified the Covenants. Both covenants came in force in 1976 when a sufficient number of countries had ratified the Covenants.

Enforcement of human rights law

There is currently no international court to administer international human rights law. The International Criminal Court (ICC) has jurisdiction over the crime of genocide, war crimes and crimes against humanity. While the European Court of Human Rights, and the Inter-American Court of Human Rights enforce regional human rights law.

Universal Jurisdiction

Universal jurisdiction is a controversial principle in international law whereby states claim criminal jurisdiction over persons whose alleged crimes were committed outside the boundaries of the prosecuting state, regardless of nationality, country of residence, or any other relation with the prosecuting country. The state backs its claim on the grounds that the crime committed is considered a crime against all, which any state is authorized to punish. The concept of universal jurisdiction is therefore closely linked to the idea that certain international norms are erga omnes, or owed to the entire world community, as well as the concept of jus cogens. In 1993 Belgium passed a law of universal jurisdiction to give its courts jurisdiction over crimes against humanity in other countries, and in 1998 Augusto Pinochet was arrested in London following an indictment by Spanish judge Baltasar Garzón under the universal jurisdiction principle.[7] The principle is supported by Amnesty International and other human rights organisations as they believe certain crimes pose a threat to the international community as a whole and the community has a moral duty to act, but others, including Henry Kissinger argue that "widespread agreement that human rights violations and crimes against humanity must be prosecuted has hindered active consideration of the proper role of international courts. Universal jurisdiction risks creating universal tyranny -- that of judges"

Is the current thinking that if the extradition is to go ahead it will happen in this no-man's land in-between Presidents? Yesterday I was checking news releases from Amnesty International. There has been a few countries who have weaseled out of protecting the Human Rights of their citizens and consequently have allowed USA personel to extradite.

Hi i have tried to contact the Democrates regarding the extradition treaty between the Us and UK but had no joy with the emails. Also i have emailed Amnesty on several occasions and they said that they are unable to help. Please try also, as if more people question this, they will hopefully get on board.

I am located in the United States. A friend of mine also hacked into NASA. He's known online as ''ytcracker'' and also is a well known 'nerd core' rapper. He defaced the website, but nonetheless he still had unauthorized access as Gary did. It might be a good idea if you talk to him, and maybe exchange info so you can get an idea of how his case progressed, what he was charged with and how long he ended up being sentenced. I actually think he might have done no time. He just recently got off probation (2008). I could hook you up with him directly. I have written a physical letter to my MP (Anne Snelgrove, for Swindon South) asking her to sign the EDM. I have used the writetothem.com website before and not got any response or confirmation that my message was received, so I think writing a letter and posting it carries much more weight. It's well worth the extra effort.

If Gary needs financial support, I would be in support of a silicone wristband campaign similar to the make poverty history initiative. It's a pretty good way of publicising Gary's case and raising funds. There are tons of UK suppliers of custom silicone wristbands. What do you guys think?

With regards to the rpkn-labour.co.uk website trace, it's complete nonsense. Don't believe a word of it. Their website is hosted in the USA, probably because it is a lot cheaper. Global Crossing is not a "known FBI supplier"; it is a large internet connectivity provider. The global crossing hops of the route are down to the poster's internet service provider; tracing the route from my connection in the UK uses a different carrier and does not utilise any of global crossing's network.

Ross Hemsworth from Glastonbury Radio has posted a message on his website about a message from his own MP. He was told that 'frontbench Tory MPS' are outraged by the current UK/US extradition arrangement, because it leaves our citizens unprotected. They are asking for a full scale debate about it in Parliament - teresa Bacon

Anybody who is able to help Gary should do so now as when he is taken forcibly away by US Marshals with nothing but his clothes he is wearing it will be a sad day for the UK justice system as there are people who are able to help Gary who have not come forward in the government who still can step in and save Gary from possible water boarding (Torture) and 70 years in prison and for what he has done helping the US to find their network problems before terrorists did something really bad. Come on go with your heart and do what is right and help this person who has done no real damage but has helped secure the US networks he looked at to find evidence of UFO and free energy. Gary McKinnon or any UK citizen does not deserve to be sent to the US and treated like a terrorist. Conservatives / Lib Dems even / Labour please come to the issue and help not just Gary but as you know many injustices in this extradition treaty.

Interesting to see that so far only 9 Conservatives have signed the EDM.

Does this mean that if elected David Cameron would be likely to keep the one sided extradition treaty that the Conservatives have previously spoken out so forcefully against.
I'm extremely surprised that Dominique Grieve hasn't yet signed.

Hopefully more Conservatives will come out of the woodwork to give us an indication of what to expect when and if they are elected.

So Far only 13 Liberal Democrats have signed the EDM despite the Liberal party openly coming out against this one sided treaty that is ruining the lives of decent families and is rarely used against real terrorists.

Evidence should have to be provided which is able to be contested before any extradition can take place.
Especially when the Criminal Prosecution Service is not only standing back to allow America to take our citizens but they are also colluding with the Americans in order to secure an extradition.
The CPS use at least four barristers and a lot of manpower to ensure that the extradition of the chosen U.K citizens takes place....Why?

14 Labour MP's (including one independent) have had the guts to go against their own leadership to sign this EDM that can hopefully get this extradition treaty back into the House of Commons for debate and much needed amendment.

This treaty should cease immediately and revert to the old treaty until U.K citizens are given the same rights as has been "given" to their U.S counterparts by our government.

Why should the Labour government have given greater rights to U.S citizens while at the very same time stripping those rights from their own U.K citizens.
We have a right to have evidence provided before extradition to America can take place?....and those hard won rights were "given" away and for no other reason than to appease the American government.

The Labour leadership have obviously forgotten that they work for us and not for the American government.

I have written to my MP, who has replied. It appears that he is on your side and I think he will do what he can. Its a shame that those who make the final decisions dont have the courage to stand up for you, for fear of the repurcussions on them of indirectly offending the good old US of A.

I fully support Gary Mckinnon's appeal against extradition to the US. It is my belief that he would face an unfair and unsympathetic trial whilst there. I beieve that a US court would not fully consider his disability and the implications that this would hold in reference to the case.

I have just read in the local paper about Gary McKinnon, and the extradition attempts being made by the USA for hacking into various databases.

Firstly I want to strongly condone this action, the UK fail people with Autism once they enter adulthood and if this extradition is allowed this sends the largest message to people with disabilities of any kind that they are second class citizens. My brother 'aged 21' has aspergers syndrome the same as Gary. He does not leave the house and spend most of his time educating himself on his computer and in books. He like Gary no doubt have an exceptionally high intelligence which is what would have lead to Gary hacking into these systems after reading his story I cried my heart out as this could so easily be my brother.

The thing people do not understand about Aspergers is the thirst for knowledge and to master their chosen path, once mastered they move on to something new and challenging.

I do not believe Gary poses any threat what so ever to the USA, they are wasting time and money attempting the extradition. How dare they say it took them millions of dollars to fix the breaches - they should be thanking him and actually asking him to try and breach them again and again as he is a weapon against terrorism.

I strongly urge you to back Gary's family is stopping this action.
